Leasing
There is no other market in the U.S. that
presents the complexity of leasing
commercial property in Manhattan. Tenants
accustomed to 5-20 page leases elsewhere are
amazed when presented with 40-100 page
leases in New York. Without experienced
legal review they may have no idea how
intricately these can be written to the
advantage of the landlord.
A
small sample of issues of concern are:

Understanding loss factor – the square
footage you pay for is much higher than
the useable square footage and this loss
factor is different from building to
building.

Escalation clauses (which can raise base
rents significantly). For example, most
out-of-state companies have never heard
of a “porter’s wage clause” (tenant rent
increases based upon wage increases of
certain union workers on the property)
not to mention whether it is with or
without fringes.

Pass-throughs for improvements, tax
increases, expense adjustments, etc.

Complicated restrictions on assignment,
subletting, alterations and other Tenant
actions.

Relocation clauses.
